The export of encryption technology from the United States is controlled by the US Department of Commerce. Many people do not realize that the definition of “export” includes electronic transfers, like email, and downloads from servers which are physically located in the US. Also, you may be exporting software even though you are not selling it. This webinar will cover the top ten things you need to know about encryption export regulations. It will also discuss how these laws affect open source projects and commercial developers who are using open source.
The U.S. Export Administration Regulations (EAR) covers what you can export, to whom, and for what use, under a number of different regulatory authorizations, each with its own requirements. Determining factors include: encryption”strength,” function of encryption, function of the product for which encryption is usually a minor feature, destination country, intended use, and even the destination organization and users. The regulations are complex, and have been revised many times since first being applied to all commercial encryption products in 1996.
